Terms of Use - Legal Disclaimer

Thank you for visiting our application Live Like Local. Prior to using and registering with our application,  please read carefully the present Terms of Use (hereinafter Terms or Agreement), as they set forth the legally binding terms and conditions for your use of LIVE LIKE LOCAL App (“Leave Like Local App” or the “App”). The use of Live Like Local App and any of its content, services and features as defined below, is subject to your prior express acceptance of these terms.

1. General

By using Live Like Local App you are entering into a legally binding agreement with Live Like Local PC, owning the App “Live Like Local”. We are a Private company, registered in Greece and our registered office is at Parikia, Paros Island, Greece. Our Services include our mobile application, “Live Like Local  App”, any interactive feature or other software and any information provided or made available by us and our website, available at: www.livelikelocal.app (including any versions optimized for viewing on a wireless or tablet device).

Live Like Local is a unique and user-friendly app that allows the user to explore the place they visit exactly like a local, enjoying services provided by local businesses and having access to information and tips that match their preferences about events, museums, restaurants, cafes, clubs, etc.

Live Like Local gathers and presents to the user all updated information and spots of interest that a visitor may find helpful during their stay at the place they have visited. It also offers a constant feed of information in real time that will be tailor made and personalized in respect with services offered by businesses that are projected in the App, in accordance to the interests of the user.

2. Registration and creation of account

As an App visitor, you would not need to register in order to enter the App, but should you wish to make use of its functions, either in whole or in part, you would have to register either by creating your Live Like Local account or by using your social platform login credentials (eg Facebook or Gmail account, etc). At your registration, you are requested to provide Live Like Local only the necessary of your personal information in order for your personal account to be created (such information being the “Registration Data”), namely your name and surname as well as your email and personal password. By registering with the App, you expressly declare that you are of legal age to form a binding contract in your jurisdiction of residence and that you receive our Services only and exclusively for yourself. All information you provide is true and accurate and you agree to update your Registration Data to keep it true and accurate. We reserve the right to suspend or terminate your account and refrain from providing you with any Services at any time and without previous notice, in case we have reasonable grounds to suspect that information registered is untrue. You are personally and solely responsible for all activities and any transaction made through your account, as well as for the security and the confidentiality of your password. You should immediately notify us of any unauthorized use of your account or for any breach of security that you may become aware of.

If you would like to deactivate your account, you can do it at any time by clicking “Delete my account” in the App’s interface.

3. Creation of profile

After registering with us, you may provide us with additional information, by answering a short questionnaire, regarding your preferences and/or your personal interests and needs so that we may be in a position to make tailor made recommendations for you by use of push notifications, based on the answers you gave and your navigation through the content of the App.

If you choose to have your geolocation service on, you will also have the opportunity to search for local businesses collaborating with the App and contact them directly through the App chat.

4. Personal Data

Any and all of your personal information, including but not limited to names, email addresses, addresses, your location will be collected and kept by Live Like Local in accordance with its Privacy Policy which can be found under the respective tab in the App.

5. License of use

By using the Live Like Local you are granted a non-exclusive, non-assignable, non-transferable and revocable license to view, display and use the App, including its content, services and features, on your mobile device or other device for your personal use only. No right of commercial use whatsoever is granted to you.

6. Payments   

Live like Local App is available to you for free. For the services provided by local businesses that are being hosted in our App, you may only make payments to them outside the environment of the App. LIVE LIKE LOCAL bears no responsibility whatsoever for the process of any such payments, cancellations or refunds and/or any dispute that may arise between you and the business hosted in our App.

LIVE LIKE LOCAL bears no responsibility whatsoever for the process of any payments, cancellations or refunds and/or any dispute that may arise between you and the business hosted in our App.

8. Exclusion of liability

Though we take all the commercially reasonable measures to provide our Services to you on a 24-hour basis, we cannot guarantee that our services will be available to you free of any disruption. We provide our services on an “as is'' basis. We are not responsible for the correctness, validity and accuracy of any information published on the App. No guarantee whatsoever is inferred from the present terms that the Services, functions and content of the App will be provided without interruption or without errors or that the App or the servers through which it becomes available to you do not contain viruses or other harmful components, although we make every reasonable effort to ensure it.

Live Like Local and any of its affiliates shall not be liable or responsible in negligence or otherwise to any person not a party to this Agreement for any information or advice expressly or impliedly given by the App, or any act, omission or inaccuracy by Live Like Local.

No rights whatsoever are inferred in favour of any person not a party to this Agreement other than Live Like Local and you. You shall, at your expense, indemnify, defend, and hold Live Like Local and our affiliates harmless from and against any and all claims, losses, liabilities, damages, actions, proceedings, costs, and expenses arising out of or relating to your use of our App and Services or your breach of this Agreement.

Live Like Local bears no responsibility whatsoever and cannot and will not be held liable for any dispute that may arise between you and any of the businesses projected in the App and/or any harm or loss you may sustain as a result of or in connection with any transaction you may enter with such business or for any other reason that is attributable to that business.

9. Inappropriate use

You shall not use the App or any of our Services to post or send any illegal, infringing, defamatory, threatening, pornographic or profane material or any material that may infringe third party’s intellectual property, or may constitute or encourage conduct that would be considered violating any law. We reserve the right, at our sole and absolute discretion, to take any action considered necessary to prevent or cure any violation, in case we determine that you have violated or you are likely to violate any of the present term’s prohibitions or any other term of this Agreement. In this case, we may immediately, without any further notice, remove any inappropriate content or material from the App, or even ban you from using our Services.

10. Suspension and termination

We may, at any time, with or without prior notice, temporarily suspend the function of any of our Services or features (in whole or in part), either for maintenance purposes or in order to update or upgrade any contents, features or functionality of the App.

We may, with or without prior notice, suspend and/or terminate your account in the event that you have breached any of these terms.
 

11. Trademarks and Intellectual Property rights

All of the content featured or displayed on Live Like Local App and all marks or any material of our Services, including without limitation to text, images and illustrations, graphics, software, source codes, designs, and each and any registered trademark and trade name of Live Like Local used herein, are owned by Live Like Local and are protected by copyright, trademark, moral rights and other laws relating to intellectual property rights. You may not copy, reproduce, republish, transmit, display, post, upload, modify, distribute or in any other way use or exploit Live Like Local trademarks or copyrights or other intellectual property rights, without our prior written consent. You expressly acknowledge that all the above remain the exclusive property of Live Like Local or its affiliates, subsidiaries, agents etc.

12. Third parties’ links

Links leading to other apps or websites may be found in the App. These are not owned, operated or controlled by us, but by third parties, and under no circumstances will we be liable for their content, privacy policies or practices, or for any financial or other type of loss or damage that you may sustain following these links. You understand and agree that you are the sole responsible person to decide whether to follow these links or not and grant the respective consent to the owners of such links.

We are not responsible for any communication between you and third service providers being advertised on the App or for any commercial transaction that may arise from this communication.

13. Amendments

We may at any time change or update this Agreement without notice. We will post any revision to these terms and you are encouraged to read carefully any such notification regarding any such change or update..

If you disagree with any changes in this Agreement and you no longer wish to be subject to the revised Terms of Use, you will need to deactivate your account by clicking “Delete my account” in the respective settings screen of the application.

14. Miscellaneous terms and applicable law

All the above mentioned terms are considered as essential. Should any of these terms be considered as violating any law, it becomes inactive and is removed from this Agreement without affecting in any way the validity of the remaining terms. This Agreement and any subsequent modification or alteration on them, as well as any additional terms are subject to the laws of Greece. If any dispute or difference arises out of or in connection with this Agreement or Live Like Local App and its Services, it shall be resolved by the courts of Naxos (Court of First Instance) or Paros (Justice of Peace of Parikia, Paros) which shall, respectively, have exclusive jurisdiction, depending on the material sum of the dispute.
